Fine Saga: MTN vs NCC postponed to March

Reports indicate that the case between MTN Nigeria and Nigeria communication commission has taken a new twist, as the case has being postponed to the 18th of March.  Reports say that this was done in hopes that the case will be settled out of court, the adjournment was made on Friday by the Federal High Court in Lagos.

According to a statement by MTN,  after the two months “If the parties are unable to reach a settlement the matter will then proceed on that date‚”. MTN Nigeria is challenging the fine levied them by the NCC, on the grounds that it was too large large enough to make the company go bankrupt and also that the NCC does not have the right to impose such a fine on the company according to the Nigerian communications acts.

The fine was levied on MTN for failing to disconnect 5.1 million unregistered subscribers. The fine was initially at the tune of $5.2 billion, but reduced to $3.9 billion, probably after due considerations by the NCC.
